These terms are between you and Milking Ducks, run by Nikki Davey in Australia.
They cover milkingducks.com and the general content, tools and resources published on it.
Our privacy policy explains what we collect about you and how we handle it.
What the content is, and isn't
Everything on this site is general information based on Nikki's own experience, ideas and business frameworks.
That includes blog posts, videos, quizzes, assessments, checklists, calculators, AI-assisted tools, templates, guides, downloads and whatever gets added next.
Some content or results may be created with the help of AI and may contain errors, gaps or outdated information.
None of it is professional business, financial, legal, accounting or tax advice, and none of it takes your individual circumstances into account.
Results from a quiz, assessment, calculator or AI-assisted tool are a starting point for your own thinking, not a verdict or recommendation you should automatically act on.
You are responsible for the decisions you make after using the site.
If something is important, high-risk or could have significant financial, legal or other consequences, check it independently or get advice from someone qualified who understands your situation.
Paid memberships, workshops and services
The Milking Ducks membership currently runs through Skool.
If you join the membership, you also agree to Skool's terms and to the membership details, pricing, inclusions and other conditions shown to you when you sign up.
Workshops, consulting, speaking engagements and other paid services may have separate terms or agreements. Where they do, those terms apply in addition to these website terms.
Prices shown on the site are in the currency stated and may change for future purchases.
Nothing in these terms removes any rights you may have under the Australian Consumer Law.
The members area
Some resources at milkingducks.com/members are intended only for current Milking Ducks members.
Access details and passwords are for members only.
Please do not share them, or copy and distribute members-only resources outside the community, unless we have given you permission.
Using our content
Unless we say otherwise, the words, images, videos, frameworks, quizzes, tools, templates, downloads and other original material on this site belong to Milking Ducks or are used with permission.
Milking Ducks frameworks, including the Business Loop, SPARC and Six Foundations, are original Milking Ducks material.
You are welcome to:
- read and use the public content for your own learning;
- share links to Milking Ducks content;
- quote short passages with appropriate credit; and
- use downloads and templates in your own business where they are provided for that purpose.
Please do not, without permission:
- copy or republish whole articles or resources;
- reproduce or distribute our frameworks as your own;
- resell our templates, tools, resources or downloads;
- copy members-only material into another community, course or product;
- reproduce our website tools or quizzes; or
- use Milking Ducks content in a way that suggests you created it.
Some photographs on the site are by Chloe Smith Photography and are used with permission. They are not available for reuse unless the relevant copyright owner gives permission.
Our social media tools
We publish content to our own LinkedIn, Instagram and TikTok accounts using tools built into the Milking Ducks website.
Those tools are used by Milking Ducks to manage Milking Ducks accounts and are not offered as a public service.
Anything published to those platforms is also subject to the rules and terms of the relevant platform.
Links to other sites
We sometimes link to websites and services we do not control, including Skool, Amazon and social media platforms.
A link does not mean we endorse everything on that site.
We are not responsible for third-party websites, their content, availability, products, services or the way they handle your information.
Their own terms and privacy policies apply when you use them.
Availability and changes
We may change, move, update or remove free website content from time to time.
We cannot promise that every part of the website will always be available, uninterrupted or free from errors.
If we become aware of a problem, we will take reasonable steps to fix it.
Changes to paid memberships, products or services will be handled under the terms that apply to those products or services.
Our responsibility
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law or any other law that cannot legally be excluded.
Subject to those rights, Milking Ducks is not responsible for loss arising solely from:
- relying on general information published on the website;
- relying on an AI-generated or automated result without checking it;
- using a quiz, calculator, checklist or assessment as professional advice;
- following a link to a third-party website; or
- temporary website outages, errors or unavailable content.
You remain responsible for deciding whether information on the site is suitable for your circumstances.
Acceptable use
Please do not use the site in a way that:
- breaks the law;
- interferes with the website or its security;
- attempts to access parts of the site you are not authorised to access;
- copies or extracts large amounts of content or data without permission;
- uses automated tools to scrape or reproduce the site in a way that harms Milking Ducks or its users; or
- infringes someone else's rights.
We may block access where we reasonably believe the site is being misused.
Which law applies
These terms are governed by the laws of Victoria, Australia.
Subject to any rights you may have to bring a claim elsewhere, disputes relating to these terms will be dealt with by the courts of Victoria and courts entitled to hear appeals from them.
